We’re Two for You in Knoxville, and we’ve served our community with diligence and compassion since 1987. You can turn to us for the support you need when trying to navigate the SSD system.

Most initial SSD claims are denied

It’s a fact that millions of disabled individuals have had to deal with — the Social Security Administration (SSA) denies most claims for benefits the first time around. There are many reasons for denials, including your income is too high, your disability is not permanent enough, drugs and alcohol are allegedly hindering your recovery, or you haven’t pursued adequate medical treatment. If you’ve been denied, you should know that there are still plenty of options available to you. There’s a robust appeals process in place, and experienced Knoxville lawyers can help determine your next steps.

The complex SSD appeals process

There are a number of steps to the SSD appeals process, and they must be taken in the following order:

  1. Request for reconsideration. As soon as possible after receiving a denial notification, you should file for a reconsideration. When this happens, your local SSA office reviews your claim and any additional information you’ve decided to include with your request.
  2. Hearing with an administrative law judge. If you’re still denied benefits, you can request a hearing with an administrative law judge (ALJ). At this hearing, you and your attorney can present evidence of your disability and prove that you can no longer earn an income for yourself or your family.
  3. Appeals council hearing. If the ALJ determines your claim should be denied, you can take your case to an appeals council, which reviews the decision. The council can deny your request for review, return the claim back to the ALJ for another look or approve your claim outright.
  4. Federal district court hearing. Your last appeal option is to sue the SSA in federal district court. To do so, you should work with a skilled attorney who has experience with a wide range of Social Security disability claims.
